Terms and Policies
GENERAL INFORMATION
Maxwell Fabrics is a wholesaler. All customers must have an account number in order to place reserves or orders.
Prices: All prices listed herein are subject to change without notice. Canadian customers will be billed in Canadian dollars and US customers will be billed in US dollars.
Fabric is stocked in Concord, North Carolina. For Canadian customers all orders are FOB Mississauga, Ontario, Canada.
Canadian customers: Minimum order quantity is one yard on fabric, in minimum ½ yard increments. Orders received for less than the minimum increments will be increased to the next ½ yard automatically and billed accordingly. Orders placed in meters will be converted to yards and rounded to the nearest ½ yard. Please note that minimum order quantity on Studio, Essentials and Telafina fabrics is two yards, with ½ yard increments after that. If ordering less than 2 yards on a Telafina item, a $25 cut fee will apply.

Packaging Fee: Orders of 15 yards or more for Velvets and special construction items are automatically placed in a box to protect the fabric. These orders are subject to an additional packaging fee; this charge will be added to the shipping cost
CANADIAN CREDIT POLICY
New accounts must submit a signed credit applications to have their account opened . Customers are either Proforma or Net 30. Maxwell does not offer COD. Maxwell has the right to change your credit terms without notice upon our discretion, based on your credit history with us. Failure to pay on time will result in orders being held until account is brought up to date. An interest charge of 2% per month (24% per annum) will apply.
We accept Checks along with Visa and MasterCard.
US CREDIT POLICY
New accounts must submit a signed credit applications and resale certificate where applicable to have their account opened. Customers are either Proforma or Net 30. Maxwell does not offer COD. Maxwell has the right to change your credit terms without notice upon our discretion, based on your credit history with us. Failure to pay on time will result in orders being held until account is brought up to date. An interest charge of 2% per month (24% per annum) will apply.
We accept Checks along with Visa, MasterCard, Amex and Checks by Phone/Fax up to $5,000 accepted.
RETURN POLICY
All fabric is checked at the warehouse before shipping; however it is still the purchaser or the purchaser's workrooms responsibility to inspect the fabric for flaws and accuracy of the pattern, colour, dye lot and face of the fabric.
MAXWELL FABRICS will not accept returns on fabric once it has been cut or processed in any way by the purchaser or the purchaser's workroom.
No returns accepted on cut yardage less than 6 yards.
No merchandise will be accepted for return without prior authorization and return code from Maxwell Fabrics Claim Department. Claim forms must be filled out and submitted with a photo before returns can be approved. The claim form is found on our website www.maxwellfabrics.com

Cut yardage accepted for return must be within 30 days of invoice date.
No returns are accepted for VELVETS, Studio collection items, special order fabrics, or fabrics that have been treated with an aftermarket finish. Please note that all clearance/discontinued items are final sale.
When returning flawed fabric please do not mark the fabric in any way. All fabrics that are accepted to be returned are inspected once they arrive back to the Maxwell warehouse. Credits will be issued within 2 weeks after the return has been received.
All fabric must be returned on the roll for credit to be given. Fabric folded or not on a roll will not be credited.
All fabrics accepted for credit due to customer error will be charged a 25% re-stocking fee plus the in/out freight and a handling charge.
Maxwell Fabrics provides a limited warranty on outdoor fabrics that become unserviceable due to loss of color or strength from normal usage and exposure to weather and atmospheric conditions, including sunlight. This warranty is valid for 3 years from date of purchase for residential application and commercial application. This limited warranty covers the replacement of the fabric only and expressly excludes labor and installation costs.
Cutting for Approval (CFA)
We have updated our policy on cuttings for approval. We guarantee the dyelot on the majority of Maxwell Fabrics' styles to be a match within industry standard to the book/memo sample. We offer cuttings for approval on select styles that may vary from dyelot to dyelot, whether due to fiber content, yarn type or construction. The minimum order quantity for a cfa, if offered on that style, remains 3 yards. Cutting for approval requests under 3 yards can be processed for an additional $25 cutting fee per item, provided cuttings are offered on that style.
If the customer receives their order and feels the dyelot is not within industry standards, the fabric will be taken back at full credit if the claim is placed with Maxwell Fabrics within 30 days of invoice date. There will be absolutely no returns on fabric that has been cut or processed in any way by the purchaser or the purchaser’s workroom.
Should a cutting of your order be required for records or identification purposes, we are happy to fulfill upon request at the time the order is cut.
Styles from our Telafina collection are eligible for cuttings for approval upon request, with a 3 yard minimum order quantity or a $25 cutting fee per item.
3% Residual Shrinkage is reasonable.
Climate conditions and humidity in the environment may cause a fabric to contract or expand after installation. We recommend that you allow sufficient fabric for these environmental changes.
Maxwell Fabrics will not guarantee against wear or fading due to environmental conditions, such as sun exposure, which is beyond our control.
Please advise your workroom that due to uncontrollable circumstances and variances in the manufacturing process, all pattern repeats listed are approximate and may vary. We recommend making extra allowances for pattern repeats when calculating your cuts as Maxwell Fabrics will not be held responsible for any shortages. Additionally, despite best efforts, occasionally pattern distortion occurs. When planning multiple width drapery/bedding please make certain, BEFORE CUTTING, that pattern alignment is adequate to produce a satisfactory end result.
Maxwell Fabrics will not accept returns on goods stored incorrectly when received by the customer. It is the customer’s responsibility to store fabric in a horizontal position without any other items placed on top to prevent crushing & wrinkling.
It is the customers’ responsibility to decide the appropriate application, suitability, properties, and characteristics for each fabric before manufacturing. Maxwell Fabrics will not accept returns on goods used or manufactured inappropriately.
Inherent characteristics of certain fabrics are not considered defects but are considered part of the natural beauty of the fabric. Therefore they will not be accepted for return.
Maxwell Fabrics will not accept returns on goods improperly cared for or incorrectly manufactured. It is the customer’s responsibility to:
• make sure proper care instructions are followed. It is important to check before ironing or steaming to prevent puckering or shrinkage.
• ensure a large enough seam allowance is used to prevent seam slippage.
• decide whether to serge fabrics after cutting & before sewing to prevent fraying and tearing at seams.
• consider the backing of a fabric before proceeding with upholstery pieces and select appropriate backing when necessary.
• select appropriate backing or lining before manufacturing drapery treatments.
• consider the constructions & wearability of a fabric when choosing bedding ensembles.
Maxwell Fabrics will not accept returns on goods showing signs of pilling after one year of invoice date. Pilling is often a normal part of wear and tear. Additionally, uncontrollable environmental factors can cause pilling that cannot always be predicted.
Maxwell Fabrics will not accept returns on goods used or abused by pets. Maxwell Fabrics is committed to carrying fabrics from suppliers that meet or exceed all industry testing and standards. However, no tests are conducted with consideration to pet use as this is not considered normal use for residential fabric. Therefore, Maxwell Fabrics cannot guarantee/warrantee any fabric where pets are present under any circumstances. It is the customer’s responsibility to choose fabric appropriately with consideration of pets in the home/environment.
Important Information:
LENGTH OF CUTS: The length of your cuts is very important in the processing of your orders. On occasion, we must fill your order with more than one piece, or make allowance for a defect in the fabric. Please include cuts on every order. Please note order over 75 yards or more will have largest + balance automatically sent. If cuts are needed they will be taken off the same dyelot.
RESERVES: We will reserve yardage for 5 business days. Cutting for Approvals (CFA’s) will be reserved for 10 business days. We are not obligated to inform customers that a reserve has expired.
SOC (SHIP ORDER COMPLETE) ORDERS: If you have multiple items on an order and some items are in stock, please note the in stock items will be cut immediately and held until the order is complete. The pattern and quantity will not be available to edit. Cancellation of in-stock items that are already cut are subject to our returns policy.
LARGE VOLUME & SPECIAL ORDERS
Backorders over 100 yards and special orders for discontinued patterns require a 50% deposit, regardless if the customer is Proforma or Net 30. This 50% deposit is non-refundable. Once the deposit has been paid, the backorder will be placed with our supplier. The remaining balance is to be paid on normal terms upon backorder arrival.
WALLCOVERINGS RETURN POLICY
Please note that wallcoverings distributed through Maxwell Fabrics are a final sale and are non-returnable.
All 1838 Wallcoverings are sold as "euro rolls" with the dimensions indicated on the website, wallcovering book and on the memo sample. It is the responsibility of the purchaser or the purchaser's paperhanger to ensure the wallcoverings quantities and dimensions ordered are accurate, and to inspect the wallcovering for flaws, accuracy of the pattern and color prior to cutting. Ensure that the paperhanger follows the hanging instructions provided and uses a good quality PH neutral, solventfree, fungicide protected, light grade adhesive as they are paste the wall wallcoverings.
Maxwell Fabrics will not accept returns on wallcovering once it has been cut or processed in any way by the purchaser or the purchaser's paperhanger. No claim will be allowed for paper hung in excess of one roll where a fault could not reasonably be recognized prior to hanging.
